1. About these terms

These terms (together with our Privacy Policy and Cookie Policy) govern your use of the SellCarInstant website and the service we provide. By using our website or accepting an offer for your vehicle, you agree to these terms. Please read them carefully.

2. Who we are

SellCarInstant is a trading name of Oakwood Motor Company Ltd, a company registered in England and Wales (company number [to be inserted], VAT number [to be inserted]), registered office at Victoria Retail Park, Victoria Street, Bury, BL8 2EQ.

References to "we", "us" and "our" mean SellCarInstant. References to "you" and "your" mean the registered keeper or legal owner of the vehicle being offered for sale.

3. Our service

SellCarInstant is a vehicle buying service. We purchase used cars directly from private sellers in the United Kingdom. The process is:

  1. You enter your registration and mileage and receive an instant indicative valuation.
  2. You upload photographs and confirm the vehicle's history and condition. The price is then locked, subject to the rest of these terms.
  3. You book a collection at our preparation centre or arrange drop-off.
  4. We inspect the vehicle, complete the sale, and pay you.

4. Eligibility

To use our service you must:

  • Be aged 18 or over;
  • Be the registered keeper and legal owner of the vehicle, or be authorised by the legal owner to sell it;
  • Provide accurate, complete and truthful information about the vehicle;
  • Have the legal right to sell the vehicle in the United Kingdom.

5. The valuation

The first valuation displayed is an indicative figure based on the registration, mileage and standard market data. It is not a guaranteed price and may change once you provide further details about the vehicle's history and condition.

6. The locked offer and 7-day price guarantee

After you have completed the vehicle history and condition questions and uploaded the requested photographs, we will display a final offer.

This final offer is held for 7 days from the date it is generated, provided that:

  1. The vehicle, its mileage, history and condition exactly match the information and photographs you submitted;
  2. The mileage at collection has not increased by more than 100 miles from the mileage you declared;
  3. The vehicle has not been involved in any accident, sustained any damage, or had any mechanical failure between the offer being generated and the inspection;
  4. You are the registered keeper and legal owner (or fully authorised to sell), and the vehicle is free from any undisclosed outstanding finance, lease, hire purchase, conditional sale, theft marker or insurance write-off;
  5. The vehicle has a valid V5C logbook in your name (or in the name of the disclosed seller);
  6. The vehicle passes our standard inspection without identifying any material issue not declared by you.

If any of these conditions is not met, we may revise our offer. You are then free to accept the revised offer or decline and keep your vehicle.

7. Accuracy of declared information

You confirm that all information you submit (including photographs) is accurate, complete and not misleading. Material undisclosed issues, including but not limited to:

  • Undeclared accident damage, paintwork, panel replacement or repair;
  • Undeclared mechanical, electrical, suspension or drivetrain faults;
  • Undeclared service history gaps;
  • Missing keys, V5C, service book or accessories;
  • Insurance category history (Cat A, B, N, S, or older Cat C, D);
  • Outstanding finance or other security interests;
  • Mileage discrepancies;
  • Modifications materially affecting value;

will entitle us to revise or withdraw our offer.

8. Photographs and the price lock

Your photo upload is what locks our price. You agree that:

  • Photographs are of the vehicle being offered, taken within 7 days of submission;
  • Photographs clearly show all panels, the interior, the dashboard with the engine running, and any damage;
  • We may use your photographs for the purposes of valuing, recording and re-advertising the vehicle.

If photographs prove inaccurate or do not show damage that is later identified at inspection, we may revise our offer.

9. Inspection and collection

  • You can choose to bring the vehicle to our preparation centre at Victoria Retail Park, Victoria Street, Bury, BL8 2EQ, or to book a collection from your address.
  • The vehicle must be available at the agreed time. Reasonable rescheduling is permitted.
  • You must produce the V5C logbook, all keys (or declare missing keys), the service book or digital service record, your driving licence, and proof of address.
  • The inspection typically takes 30 to 45 minutes.

10. Bring-to-site bonus

Where you bring your vehicle to our Bury preparation centre rather than booking a collection, and our locked offer for your vehicle is £1,500 or more, we will add £100 to the agreed offer at the point of inspection, provided:

  • The vehicle passes inspection without revision;
  • The sale completes the same day;
  • You are the registered keeper or legal owner with all required documents.

The bring-to-site bonus does not apply where our locked offer for your vehicle is below £1,500.

11. No admin fees

We charge no administration, transaction, collection or processing fees. The price you accept is the price we pay (subject only to legitimate revisions under sections 6, 7 and 8).

12. Payment

We aim to pay you by Faster Payment on the same day the sale completes, provided the sale completes during banking hours. Payment is made to a UK bank account in your name (or the legal owner's name).

Where there is outstanding finance on the vehicle, we will:

  • Settle the outstanding finance directly with your lender; and
  • Pay any positive equity to you.

If the outstanding finance exceeds our offer, you must pay the difference before we will purchase the vehicle.

13. Cancellation and withdrawal

  • You may withdraw from the proposed sale at any point before the vehicle is handed over and payment is made.
  • We may withdraw or revise our offer if any of the conditions in sections 6, 7 or 8 are not met.
  • Once title in the vehicle has passed to us and payment has been made, the sale is final.

14. Outstanding finance, write-offs and stolen vehicles

  • You must declare any outstanding finance, lease, hire purchase or conditional sale agreement on the vehicle.
  • You must declare any insurance category history (Cat A, B, N, S, or older Cat C, D).
  • You must not offer a vehicle that is, to your knowledge, stolen or subject to a theft marker.
  • We carry out HPI and finance checks at inspection. Any undisclosed issue will entitle us to revise or withdraw our offer.

15. Limitation of liability

Nothing in these terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation;
  • Any other liability that cannot lawfully be limited or excluded.

Subject to that, our total liability to you in connection with these terms is limited to the price of our offer for your vehicle.

We are not liable for any loss caused by your providing inaccurate or incomplete information.

16. Use of our website

You may not use our website to:

  • Submit a valuation request for a vehicle you do not own or are not authorised to sell;
  • Submit false, misleading or fraudulent information;
  • Interfere with the operation of our website;
  • Use automated means to access our service.

17. Intellectual property

All content on the SellCarInstant website (including our brand, logos, copy, design, code and photographs) is owned by us or licensed to us. You may not copy, reproduce or use it without our written permission.

18. Force majeure

We are not liable for any delay or failure to perform our obligations caused by events beyond our reasonable control, including but not limited to acts of God, fire, flood, severe weather, war, terrorism, civil unrest, industrial action, failure of utilities, telecommunications or transport networks, cyber attack, or government action. We will use reasonable efforts to resume performance as soon as practicable.

We will acknowledge your complaint within 5 working days and aim to provide a final response within 28 days.

20. Alternative dispute resolution

If we cannot resolve your complaint to your satisfaction, you may be able to refer it to an alternative dispute resolution (ADR) provider. ADR is a process for resolving disputes without going to court.

21. Changes to these terms

We may update these terms from time to time. The version that applies to your sale is the version in force on the date your offer was generated.

22. Notices

Any notice we give you under these terms will be sent to the email address or postal address you provided when getting your valuation. Any notice you give us should be sent to the contact details in section 19.

23. Severability

If any part of these terms is found to be unenforceable, the rest will remain in full force. The unenforceable part will be replaced by an enforceable provision that, as closely as possible, reflects the original intent.

24. Entire agreement

These terms, together with our Privacy Policy and Cookie Policy and the offer summary we send you, form the entire agreement between you and us in relation to the sale of your vehicle. They replace any earlier agreement or representation, whether written or oral.

25. Assignment

You may not transfer your rights or obligations under these terms without our written consent. We may transfer ours to any company within our group.

26. Third party rights

These terms do not give any third party any right to enforce them under the Contracts (Rights of Third Parties) Act 1999.

27. Governing law and jurisdiction

These terms are governed by English law. Any dispute arising from them is subject to the exclusive jurisdiction of the courts of England and Wales.
